Since 2010, you can use maternity capital to build a house. At the same time, the constructed housing must meet the requirements prescribed by law, and if the construction was carried out on its own, then it is necessary to account for the money spent.
In addition, the Pension Fund has the right in a number of cases to refuse to issue a certificate for maternity capital. In our article we will tell you how to get this money, what you can spend it on and what to do if you are denied these funds.
Conditions for obtaining capital for building a house
To be allowed to use maternity capital to build a house, you must meet certain conditions:
- The house will be built in the Russian Federation.
- The right to real estate arose later than January 1, 2007, if capital is needed to bring an unfinished house into a habitable state (compensation payments can be received for previously built objects).
- You have notified the department of the Ministry of Construction and Architecture that you plan to build a house.
- The building will be erected in compliance with construction technology, in compliance with SanPiN standards, and this is confirmed by the design and estimate documentation (PDD).
- After the house is completed or reconstructed, you will register ownership (allocating shares for your husband, wife, and children).
- The living area of the house is large enough to meet the accounting standard for one family member. You can find out what dimensions a building should have from your local government.
- The money borrowed is used for the intended purpose, which is specified when the contract is drawn up.
- You have the legal right to own the site where the house will be built. The developer can be the owner of the land, lease it, use it indefinitely or free of charge, or receive it as an inheritance. The owner of the plot can be either the certificate holder (mother) or her legal spouse.
The type of intended use of land can be one of two:
- for individual housing construction (IHC);
- for running personal subsidiary plots (LPH).
Documents for obtaining maternity capital for building a house
If you have a second (or subsequent) child, you can receive a certificate for maternity capital to use it to build a house. To do this, you need to contact the Pension Fund of the Russian Federation.
Most often, the child's mother is the recipient. According to the conditions for obtaining maternity capital for the construction of a house, it is necessary to prepare documentation.
The package of documents includes:
- passport;
- insurance number of an individual personal account;
- certificate for receiving maternal capital;
- a document confirming the right of ownership of the land plot owned by the mother (or her husband);
- permission (in writing) for construction;
- a certification confirming that the house will be registered as family ownership within six months from the date of completion of construction work.
The Russian Pension Fund will verify the application, as well as all provided documents. Only after this will a bank account be opened in the recipient's name. Only the owner of the certificate, that is, the mother, will be able to withdraw the funds.
If you plan to build a house yourself, you will have to collect all the necessary documents related to construction.
It is recommended to prepare them in advance. The best option is when you already have documents when receiving maternity capital to build a house.
What documentation will be required:
- purchase and sale agreement (or lease) for a land plot;
- building permit;
- House project;
- estimate, which includes the cost of construction work, as well as all necessary materials;
- an agreement with a construction company (or individual entrepreneur) that will build the house.
You will also need to open a bank account to which maternity capital will be transferred.
Note! There is no need to enter into a deposit agreement. Also, the financial institution should not charge a commission for the transfer.
Maternity capital for building a house without waiting three years
Holders of maternity capital are interested in the issue of using the funds on the certificate before the child reaches 3 years of age. Many people can’t wait to complete construction and move into their home. Some families are worried about exchange rates and rising prices for materials and work crew services.
Before the deadline - three years - spending money on the certificate is possible in two cases.
1) Making a down payment on a mortgage
2) Repayment of a loan for the construction or reconstruction of a residential property
It is prohibited to take out a construction loan from institutions that issue microloans.
Instructions for obtaining capital for building a house
If by law you must be provided with maternity capital, then you can find out the procedure for receiving funds in Article 5 of the Federal Law “On additional measures of state support for families with children.” Articles 7, 8 and 9 of this law contain information on how maternity capital can be used.
To receive maternity capital for building a house, proceed as follows:
- prepare the required documentation for the Russian Pension Fund to obtain a certificate;
- then fill out an application for maternal capital. A sample of it can be found on the Internet, taken from the Pension Fund, or filled out a form on the portal www.pfrf.ru or www.gosuslugi.ru;
- You will receive a certificate on the specified date. It is he who proves your right to maternity capital, which you use to build a house;
- decide on the target direction for spending maternity capital. The money can be spent entirely or in parts. Multi-purpose use of the allocated amount is acceptable;
- collect a package of documents for the Pension Fund of the Russian Federation to confirm the target direction that you have chosen;
- submit an application to the Pension Fund, indicating to the Russian Federation that you want to use family capital. Write down the required amount for the selected target direction;
- within two months, employees of the Pension Fund of the Russian Federation will check the legality of your application. Then a decision is made, which you will be informed about in a letter;
- After this, the Pension Fund will transfer the specified amount to your bank account. Funds will arrive within the third month after you submit your application. Refusal to issue maternity capital is quite rare. However, even in such a situation, you can write the application again, indicating in it a different intended use of the money. You can also appeal the refusal by contacting the court.
To obtain maternity capital for building a house, you need to go through two stages:
- receive a certificate;
- manage money.
It is worth noting that obtaining a certificate is always the same. The second stage will differ depending on the target direction. This is explained by the fact that the rules for managing maternal capital in these areas are prescribed in the articles of the above law.
Obtaining a loan for maternity capital to build a house
The amount of maternity capital is not enough to build a house, even if you build the building yourself, without contacting a construction company.
To improve your living conditions, take out a loan against capital. But, before signing an agreement to receive this banking product, you should understand the conditions for issuing a loan.
The law states that the certificate holder has the right to receive a loan product from a financial institution that has a license (more than 3 years). However, in reality, you can only get a mortgage using capital at a bank.
A banking organization will provide you with borrowed funds if:
- you are 21 years old. At the same time, when the loan term ends, your age should not exceed the retirement age;
- you are a citizen of the Russian Federation;
- you have a residence permit in the region where the bank is located. However, some banking organizations accept temporary registration (in this case, additional conditions may be imposed on you);
- Work experience at the last place of work was from 6 months to a year.
Such requirements are put forward by many banking organizations that issue mortgages against maternity capital. If you want to apply for a loan product, proceed as follows:
- visit the Pension Fund of the Russian Federation to obtain a certificate confirming that you are a certificate holder;
- choose the best option for investing your capital. This may be partial repayment of the loan or payment of the down payment;
- draw up an agreement with the bank;
- write a statement to the Pension Fund of the Russian Federation stating that you are going to use matkapital, attach the required documentation.
No more than 40 days after the application is approved, the money will be credited to your bank account. To apply for a loan, prepare the following list of documents, standard for all banks:
- identification document of the borrower, guarantor or co-borrower;
- marriage certificate;
- birth certificate of the child, if he has not reached the age of majority;
- maternity capital certificate;
- certificate of average earnings;
- documents for the collateral that you provide to the lender.
Note ! Depending on the bank, additional documents may be required. You also need to fill out a form to receive a mortgage using capital.
How to use maternity capital to build a house in 2020
Matkapital is issued in equal halves.
To receive the first part of maternity capital, you need to contact the MFC or the Pension Fund. There you receive a list of documents:
- obligation to receive maternal capital;
- building permit;
- certificate of availability of a personal account.
The obligation is issued by a notary upon presentation of passports, marriage certificates and birth certificates.
To obtain a building permit, you must have a town planning plan for the land plot (GPZU). GPZU is issued by the city administration after writing an application. After the GPZU is issued, an application for a construction permit is written. The plot number, cadastral number, original plot plan, and a photocopy of the plot ownership certificate are entered there.
A personal account is opened for the owner of the family capital. The certificate is issued by the bank where the account is opened.
All other documents are made directly at the MFC, mostly photocopies.
The second part of maternity capital
issued upon presentation of a certificate of completion of work. By this time, the foundation, walls and roof should be ready. To obtain the certificate, an application is written with a detailed description of the erected structures. Including the type of cladding, roofing, type of concrete, type of insulation, type of foundation, double-glazed windows - in a word, everything that has been done. Frequently asked questions about maternity capital for building a house
1. Will they be allowed to spend maternal capital on the construction of a second house or reconstruction of the first?
Is it possible to use maternity capital to build a house if you have one (or more) apartment? There is no provision in the law that you are obliged to spend money on purchasing only your only or main home. However, the constructed property must be residential, while improving the living conditions of your family. In theory, you can even use maternal capital to build a cottage outside the city, without central heating, to which you will only come on Saturdays and Sundays.
In reality, the Pension Fund often refuses to issue funds. Reason: the house does not meet the requirements or the family capital is not used for its intended purpose. However, even in case of refusal, the decision of the Pension Fund of the Russian Federation can be challenged by appealing to the court.
It will not be possible to spend maternal capital on purchasing land. Funds can only be spent on the construction of residential real estate.
Also, with this money you can restore an existing house, improving living conditions. For example, make an extension, turn a non-residential premises into a living room, replace structures. Restoring a house using maternity capital is allowed if more than 3 years have passed since the birth of the second baby. Of course, you can reconstruct the house right away, but at your own expense. When the child turns three years old, you should contact the Pension Fund with documentation confirming that you have reconstructed the house.
2. Is it necessary to wait three years to receive maternity capital?
The law states that until the second child turns 3 years old, it is prohibited to use maternity capital to build a house. However, not every family can wait that long.
What to do in this case? There is an exception regarding the loan and the obligations associated with it. For example, if you get a mortgage to build a residential property, you can use your family's equity to pay off part of the loan. Matkapital acts as a down payment. In these cases, you do not have to wait until the baby reaches three years of age.
Note! It does not matter when you took out a loan to build a house (before or after the right to maternity capital arose). The main thing is that you use the money for its intended purpose.
3. Why can they refuse to issue maternity capital for construction?
In some cases, the Pension Fund of the Russian Federation refuses to provide funds. Why this might happen:
- parental rights are limited or you have lost them;
- the adoption has been cancelled;
- you returned the baby you took from the orphanage;
- you have committed a crime against a child (caused harm to health, deprived of liberty, killed, committed violence). All violations are specified in the Criminal Code of the Russian Federation;
- you provided false or distorted data to the Pension Fund. For example, they deliberately increased the amount required for construction, used forged documents confirming the right to a land plot;
- Not all documentation was provided. In this case, you just need to bring the documents that the Pension Fund will require.
If you do one of the above actions, you will be denied maternity capital for building a house. Make sure there are no violations before submitting your application.
Maternity capital for building a house in 2020 – conditions and requirements
You can make your life better and more comfortable in different ways. One option is to use maternity capital (MK) for this. Many families make a responsible, but correct and far-sighted decision - to build their own home with government subsidies.
It is clear that the amount of the benefit alone (the amount of maternity capital in 2020 is about 453 thousand rubles) is not enough to build a good house from the zero phase to the finishing stage. However, this money is quite enough to cover the basic costs of building materials.
Example
New frame-type houses, which are becoming increasingly popular in the European part of Russia, are built in 3-5 months. The cost of building materials (if you are going to build on your own) will not exceed 300-450 thousand rubles.
Maternity capital will cover this amount either in full or in large part. True, you will have to build the house and carry out the finishing on your own. But the bulk of the costs will be compensated by the state.
There are other options for using MK - repaying a loan taken for the purchase of real estate, compensation for construction funds. All these methods will be discussed in detail in a separate section of the article.
It must be remembered that the law equates the reconstruction of your home to construction. That is, if you want to expand the area of the house, add a floor, turn the attic into an attic, the costs of such events can also be covered with public money.
The main thing is to document all the work in order to provide the Pension Fund with evidence of the costs of constructing or reconstructing the building. It’s better to notify this organization in advance about your plans and agree on a subsequent refund or preliminary transfer of funds.
Please note this important detail!
The state will not reimburse money spent on repairs (updating communications, finishing facades, installing suspended ceilings or new windows). It is prohibited to direct family capital to such needs - apparently, repairs are not considered a way to improve living conditions.
