State fee for registration in an apartment

Features of Moscow registration

The registration procedure carried out in the capital does not differ from the all-Russian registration practice. However, compared to other regions of the Russian Federation, registration in the capital is characterized by increased control.

Regulatory acts that address this issue:

  • Law of the Russian Federation No. 5242-1 on the right of citizens of the Russian Federation to free movement and choice of place of residence;
  • Housing Code of the Russian Federation;
  • Civil Code of the Russian Federation (Part 1, Chapter 3, Article 20);
  • Government Resolution No. 9 of January 15, 2007 on migration registration;
  • local document - decree of the Moscow government on registration/deregistration in Moscow (No. 859-PP).

Due to the huge influx of people who arrive in the capital for the purpose of residence, migration control measures are applied here. The registration stamp placed in the passport is a guarantor of legality in matters of residence and registration.

Documents for registration at the place of residence

To obtain permanent registration, applicants apply to the Main Directorate for Migration Issues of the Ministry of Internal Affairs of the Russian Federation (until 2020 - FMS).

List of documents submitted for permanent registration:

  • Application (form No. 6). It is signed by two people - the applicant himself and the owner. You can view a sample application here.
  • Applicant's passport. If a child under 14 years of age is registered, the parents submit their passport and birth certificate.
  • Passport of the owner of the home (if the living space does not belong to the state).
  • A document confirming ownership of the living space where the citizen will be registered/registered.
  • Written consent of the owner and persons living in the apartment to register the applicant.

    If the owner of the property or another person who must give his consent cannot be personally present during registration, then a notarized consent must be submitted.

    If a person is registered in housing that is state or municipal property, then he will need to first enter into an additional agreement to the rental agreement with the Moscow Housing and Housing Institution.

Employees of the Main Directorate for Migration Affairs of the Ministry of Internal Affairs of the Russian Federation, within three days, issue the applicant with a registration certificate and put a mark in his passport that the citizen is registered with the above-mentioned service.

Registration and registration in the Moscow region: what are the differences, how to apply

Before moving on to information about why registration in the capital region is needed, what opportunities it provides, how it can be obtained, for how long, etc. Let's figure out whether the concepts of “registration” and “registration” differ at all, and if so, then in what way. Why are we starting with this? Because often people don’t know what exactly they need to formalize, and they get lost among the colossal amount of information that they find when searching for “Residence registration in the Moscow region.”

So, registration is a term familiar from Soviet times, which has lost its meaning in legal terms since 1993. The word “registration” used to mean permanent registration at the place of residence. At the moment, only the term “registration”, permanent and temporary, has been preserved. When talking about registration, many, as a rule, mean permanent registration, which is indefinite. And if for some purpose a person needs “registration,” then most often it is a temporary one, which is always issued for a certain period (from six months to 5 years).

What is better: registration or registration?

The fact is that these documents satisfy different requirements. And your choice should depend on why you needed this or that document.

Temporary registration is a document certifying your temporary place of residence. Registration allows you to:

— Successfully get the desired job.

— Quickly obtain approval from the bank to obtain a loan.

— Obtain some documents (driver’s license, foreign passport) without going to the place of permanent registration.

— Attach a clinic in the Moscow region, enroll your child in a kindergarten or school.

— Obtain a medical insurance policy.

Permanent registration (propiska) provides the opportunity to carry out a full range of actions and receive all the necessary government services in the Moscow region:

— Register with the tax authority (receive a TIN certificate).

— Replace your Russian passport or international passport as soon as possible.

— Register the car with the traffic police.

— Register with the Pension Fund (get SNILS).

— Participate in voting at your place of residence.

— Register a legal entity. face.

And these are just the basic actions that you can freely perform in Moscow without constantly traveling to other regions of Russia. Of course, this list includes everything listed regarding temporary registration.

How to obtain a residence permit or registration in the Moscow region?

The algorithm for obtaining all documents is extremely simple. First, you need to decide what needs to be issued: permanent or temporary registration. Afterwards, you collect the entire package of necessary documents and contact the appropriate authorities.

What documents are required to obtain residence permit or registration?

You will need to provide the following documents:

— Passport of a citizen of the Russian Federation with a stamp of permanent registration. If there is no mark in the passport, then confirmation of Russian citizenship will be required.

— Military ID, conscript registration certificate.

— When registering spouses - a marriage certificate.

— When registering for a child under 14 years of age - his Birth Certificate.

In addition, it is worth mentioning that deregistration from the previous place of residence occurs automatically upon new registration, that is, there is no need to additionally deregister from the old apartment.

Advantages of permanent residence in Moscow

Permanent metropolitan registration opens up benefits and relaxations in business for citizens. Let's find out which areas benefit from permanent registration in Moscow.

Permanent registration in Moscow with a stamp in the passport

Employment

To work in the capital and receive higher wages than in the regions, temporary registration is sufficient. But there are moments in which permanent registration is indispensable.

When permanent registration is required:

  • if a citizen applies for a position in government agencies in Moscow;
  • when applying for a job in a municipality.

If two candidates of equal merit apply for a vacancy, preference will be given to the applicant with permanent registration.

You can also run your own business with permanent registration.

Social card for Muscovites

Permanent registration entitles you to a social card for a capital resident. The social card is issued to socially vulnerable groups.

Benefits that cardholders have:

  • pensioners ride for free on public transport, students are given the right to preferential travel;
  • all categories of beneficiaries receive discounts on goods and services;
  • pensioners have the opportunity to call a social taxi;
  • School students are entitled to meals without payment.

Benefits for pensioners

Moscow has the best pension provision. Here pensioners receive the highest payments compared to other regions. Pension amounts start in the capital from 17.5 thousand rubles. This is what people who have 10 years of permanent registration experience receive.

Due to the increase in the retirement age, the Moscow government introduced a law on benefits for Moscow pensioners - women will receive benefits from the age of 55, men from the age of 60, before they retire.

Medicine

No one will be left without emergency assistance in the capital. It will be provided without Moscow registration. But you can’t count on full-fledged medical care without registration. And this applies to both adults and children.

Specialized Moscow clinics have a system of restrictions regarding the admission of citizens who do not have capital registration.

Kindergarten and school

Families with temporary registration may encounter difficulties in registering their children in preschool and school institutions located at their place of actual residence. To place a child in an institution located close to home, permanent registration is required.

Loans

It is much easier for citizens who have a permanent Moscow residence permit to get a loan or mortgage. People who work at enterprises in the capital, but have temporary registration, receive refusal from banks more often than consent.

Where to submit documents?

The registration of citizens is carried out by the Main Directorate for Migration of the Ministry of Internal Affairs of the Russian Federation. You can submit a package of documents directly to the migration department or to multifunctional centers.

Temporary and permanent registration - what is the difference?

According to Art. 27 of the Constitution of the Russian Federation, citizens are given freedom of movement. At the same time as this right, Russians have the obligation to register at the place of arrival if a person intends to live there for more than 90 days. Such accounting is called temporary registration.

Permanent registration is the place where a citizen lives on a permanent basis. Temporary registration is a place where a citizen lives for some time, while permanent registration remains. During temporary registration, a stamp is not placed in the passport, but a special document with a seal is issued.

If a citizen rents housing and is registered in the same city, he is still required to obtain temporary registration at the place of actual residence.

With temporary registration, the owner can remove a person from the property at any time. With permanent registration, you cannot discharge a tenant without his knowledge and against his will.

Temporary registration is issued for stays longer than 90 days:

  • in hospitals;
  • in hotels;
  • in rented housing;
  • in homes for the elderly.

The validity period of registration on a temporary basis is from six months to 5 years.

Failure to obtain temporary registration beyond the established deadlines is a violation of the law. For fictitious permanent registration (when a person does not actually live at the registered place of residence), a fine of 100 to 500 thousand rubles is provided.

The difference between permanent and temporary registration

Citizens of the Russian Federation have the right enshrined in the Constitution in Chapter. 2 tbsp. 27, move freely throughout Russia. But there is one condition that every resident must comply with. After arriving in another region or region, a person is obliged to contact the appropriate service within 3 months to register for temporary registration.

This is a temporary registration, which indicates the applicant’s place of residence:

  • Hotel;
  • Hospital/sanatorium;
  • Rental apartment. This can be a commercial lease or a social one;
  • Dormitory or boarding school;
  • Nursing Home/Veterans Home.

This is important to know: How to check your registration

Even if a person has a permanent residence permit in the city, but rents another home here, he will need to obtain temporary registration. This will avoid unnecessary conflicts with law enforcement agencies.

Temporary registration is not permanent. Its validity period is set from six months to 5 years. There are no marks in the passport. The citizen is issued a certificate to present it to other authorities.

The cost of the above paper in Moscow is 4,500 rubles per year per person. What does this certificate give a person:

  • You can get a job;
  • Free medical care;
  • You can register your children for kindergarten and school;
  • The documents are used to enter into an agreement with a financial institution to provide a loan.

Registration without the opportunity to apply for an apartment

The biggest difficulty in obtaining permanent registration is finding where to register. It’s good if you have the funds to buy your own home or a share of it. If there is no living space on the property, you need to find a Muscovite who will register the newcomer in his apartment.

What can stop him from doing this:

  • The owner of a privatized apartment can give permission for permanent registration, while the registered tenant will not have any property rights, but it is not so easy to evict the registered tenant (only through the court).
  • A person with permanent registration has the right to register his children who have not reached the age of majority in the same living space where he is registered. Moreover, he can do this without the consent of the owner. Eviction of children is extremely problematic even through the courts.
  • If you register a close relative, it is extremely difficult to evict him from the apartment. The court may decide that he is a family member and leave him to live in the apartment.

To avoid misunderstandings later, home owners, when registering people in their living space, must enter into an agreement with notarization.

The contract must include:

  • the period for which permanent registration is granted;
  • the fact that the registered person does not have the right to dispose of the living space;
  • by whom the registered citizen is the owner.

Agreement between the owner of the property and the registered

The question regarding the registration of children is the most difficult. Here the law is on the child’s side. It is important to stipulate this point in the contract.

If you register a person in housing from the municipality, the owner may lose part of the property - the registered tenant will receive the right to part of the apartment if the privatization process begins.

To deprive a tenant of this right, he will have to be evicted. But only the state can do this, and if there is a violation of the rules:

  • does not live at the registration address;
  • brings strangers;
  • there is no payment for utilities;
  • there are complaints about behavior from neighbors.

Permanent registration without the right to living space

The main problem preventing permanent registration is the lack of residential space in Moscow. Of course, if you have enough money to build your own house or purchase a ready-made apartment, then there should be no problems with registration.

Lack of money leads to the need to look for housing and ask the owner if he can register it. Not everyone will go so far as to arrange for a relative or a stranger to live in an apartment.

Those who own privatized residential space have the right to register others, but without the latter’s right to an apartment. However, such tenants can only be evicted through the courts.

Here you should pay attention to the fact that the presence of permanent registration allows you to register minor children in the same living space, without the permission of the owner. In this case, eviction, even through the courts, will become difficult.

The forced eviction of a relative or loved one who has a residence permit at this address may become impossible. In court, it is possible to recognize a citizen as a family member and allow him to live. To avoid conflict between relatives, when providing registration, it is recommended to conclude an agreement certified by a notary.

The terms of the agreement state:

  • For what period is registration provided?
  • It is stated that this citizen does not have the right to dispose of living space;
  • It is necessary to indicate the family ties between the owner of the apartment and the citizen who is registering.

The presence of this document will simplify the procedure for eviction of registered citizens if there is a need to sell or exchange an apartment.

Below are examples of an agreement on the provision of living space:

Should not be registered in municipally owned housing. In this case, there is every chance of losing part of the area.

Everyone who is registered in the specified property can demand the allocation of part of the living space in the event of its privatization. In order for a citizen to not be able to use such a right, he must be evicted from his home, but this should be done by the state and only after the person has violated the rules for using the apartment. In particular:

  • Not living at the address or the appearance of unauthorized persons on the territory;
  • Utility debts;
  • There are complaints about the immoral behavior of the tenant.
