In Art. 36 of the Housing Code (LC) lists objects related to the common property of the owners of premises in an apartment building (MCD). This list also includes elevators. The documents contain requirements for the condition of stationary lifting machines, the procedure for their inspection and other provisions.

Life time

For any equipment, a period is established during which it must be operated without failure. This parameter is usually recorded in its technical data sheet. As for the service life of an elevator in a residential building, the standard is reflected in clause 5 of Art. 4 Regulations. It says here that in the absence of such information in the passport, the period of operation is 25 years. After this period, the elevator cannot be used for its intended purpose without an examination of its technical condition.

The equipment must be inspected by a company accredited for this type of activity; as a result, it determines the maximum service life of passenger elevators. Based on the results of the examination, a report is drawn up, which recommends either extending the operation of the lift, or modernizing or replacing it. Information about the inspection is recorded in the passport of the stationary lifting machine.

The appearance of such a paper should be preceded by a thorough examination of all elevator systems and mechanisms , by qualified persons, in the presence of representatives of the management company or HOA, as well as an active group of proactive representatives of residents who are not indifferent to the fate of the common property of the house and their own money. Elevator equipment, operating almost continuously, is subjected to constant loads, while various components and parts undergo unequal wear due to different intensity of work.

The general meeting of tenants-owners must, by a majority vote, decide on the need to carry out major repairs of elevators (Part 1 of Article 189 of the Housing Code of the Russian Federation).

The duration of the work depends on the complexity, labor intensity and volume of work; the contractor draws up a schedule for their production, linking the technological sequence of operations.


The scope of work is determined by the result of the examination , and a decision may be made on the need to replace or repair a number of components, mechanisms, elements, and if these operations are irrational, then it is logical to immediately replace the old elevators with new ones.

This proposal can only be made by an accredited company based on its calculations and estimates, and the final decision rests with the management company and the owners.

Typically, major repairs of elevators - the list of works includes:

  • inspection of the shaft and mechanisms, elevator components;
  • drafting;
  • construction works;
  • dismantling and installation of new components or the entire elevator;
  • electrical work;
  • automation, dispatching;
  • preparation of documentation and carrying out the necessary approvals;
  • commissioning works;
  • transfer into operation.

Each case is unique, so there is no single recipe for how to revive a lift quickly and inexpensively.

Housing Code Art. 154 gives a complete and unambiguous answer as to who pays for the major repairs of the elevator, and who organizes and controls the progress of the repair work. If the residential premises belong to the owners, then in paragraph 2 of part 2 of Art. 154 states that payments are made by the owners of the apartments; the money is accumulated through fees for major repairs.

1. Payment for the maintenance and repair of residential premises, including fees for services and work on managing an apartment building, maintenance, and routine repairs of common property in an apartment building;

When housing is occupied by a tenant, the landlord allocates funds (clause 1, part 2, article 154).

The rules for the operation and maintenance of elevators in apartment buildings are established by the Technical Regulations of the Customs Union 011/2011 “Safety of Elevators”, approved by the decision of the Customs Union dated October 18, 2011 No. 824.

Appendices 1 and 3 of the regulations detail the safety requirements for elevators and schemes for confirming equipment compliance with these requirements. According to Part 5 of Art. 4 TR CU 011/2011, if the equipment passport does not indicate information about the service life, then it is equivalent to 25 years from the date of commissioning. Then it is prohibited to use it without preliminary examination (Part 3.4 Article 4 TR CU 011/2011). The test results will show whether the equipment can be upgraded or needs to be replaced.

Monitoring compliance with the requirements of the Technical Regulations is one of the main tasks of the Federal Service for Environmental, Technological and Nuclear Supervision (Rostechnadzor).

Based on the results of inspections of elevators in terms of compliance with the requirements of the Technical Regulations, Rostechnadzor turned to the Government of the Russian Federation with proposals to improve the safety of elevator operation. Specialists of the supervisory authority, when checking elevator equipment, identified facts of substitution of concepts. In the apartment building, under the guise of replacing elevators, only their modernization was carried out, which required lower costs. At the same time, retaining some parts of the old elevator reduced its safety level.

According to the Rostechnadzor website, the Government of the Russian Federation held a meeting on this issue, the results of which are reflected in the letter of the Ministry of Construction dated January 29, 2018 No. 2695-NS/06.

The document clearly defines the term “modernization” and its differences from “replacement”. According to letter No. 2695-NS/06, regardless of the terminology included in the design documentation, the elevator is considered modernized if at least one old element remains after the repair.

In addition to theoretical and terminological issues, the Russian Government is trying to solve the problem of financing the repair and replacement of elevators. The task is not easy, because a quarter of all elevators in Russian apartment buildings require modification. And their number is constantly growing, since owners of apartment buildings often do not have the opportunity to fully and quickly raise funds: the cost of such work is from one and a half million rubles and more.

The Ministry of Construction of the Russian Federation sees another way to obtain funds to replace elevators declared unsuitable. The Ministry has prepared a draft Decree of the Government of the Russian Federation, which will allow, within the framework of the regional overhaul program, the priority replacement of the elevator, which is dangerous for residents.

According to Part 2 of Art. 4, part 4 art. 6 TR TS 011/211, assessment of compliance of elevator equipment with technical requirements for safe operation must be carried out at least once a year. This must be done by an authorized organization. If the inspection shows that the service life of the elevator has already expired, it must be replaced. If a malfunction is detected in the operation of the equipment, the elevator is modernized.

The decision to carry out repairs or replacement of the elevator is made by the owners of the premises at a general meeting. The initiator of the OSS can be the management authority or the owner of the premises in the house (Article 45 of the Housing Code of the Russian Federation). To make a positive decision on this issue, the consent of at least two-thirds of the total number of votes of the owners of residential and non-residential premises is required (Part 1 of Article 46 of the Housing Code of the Russian Federation).

Having confirmed consent to carry out the work, the OSS decides which source of funding will be used:

Owners of apartment building premises fully pay for the work required to replace the elevator or its individual elements.

Costs are divided between the owners and the federal budget. In this case, it is necessary to go through a commission that takes into account the service life and condition of the elevator, the condition of the apartment building and the amount that the residents of the building can provide

Under this program, work is being carried out in the participating regions to replace failed lifts at the expense of budget funds.

As a rule, the repair period does not exceed one to two months, depending on the number of elevators and floors in the building. Acceptance of work in accordance with the requirements of Technical Regulations CU 011/2011 is carried out by representatives of the management organization.

While the highest authorities of the Russian Federation are thinking about solving the problem of replacing tens of thousands of broken or expired elevators, management organizations must remember: they are responsible for the condition of the elevators and the safety of residents when operating the equipment.

In 2017, 20 regions joined the program.

Problems with putting elevators into operation arose in Moscow, in the Moscow, Murmansk, Lipetsk, Belgorod and Arkhangelsk regions, as well as in the Khabarovsk Territory. Moreover, the problem is not technical. The craftsmen installed new elevators and have already left the facility; no work is being done. But bureaucratic delays force residents of houses to engage in fitness against their will.

On the first working day of the new year 2020, at a meeting of the Government of the Russian Federation chaired by Deputy Prime Minister Dmitry KOZAK, they finally discussed a blatant absurdity: the modernization of old elevators as part of overhauls is being successfully carried out in Moscow and Yekaterinburg, but Rostechnadzor is increasingly refusing to endorse acceptance certificates, citing , that ... there is no such concept in any regulation - “modernization”. They say write “repair” or “replacement”, but modernization is too vague and unsteady...

Tens and hundreds of stopped elevators in the country are not just a technical problem. Everything is much worse: the leadership of Roskomnadzor is trying to at least somehow cover up its ... reputation against the backdrop of high-profile accidents. In June 2020, a woman died in an elite high-rise building in North-East Moscow: the bottom of the elevator cabin fell off at the height of the 7th floor. Answering questions from the media, the vice-president of the Elevator Union, Alexei ZAKHAROV, spoke quite unequivocally: “For the counterweight to break and destroy the cabin, certain events must occur. For example, shrinkage of the building and deformation of the guides..."

Here it should be clarified that “guides” are the main safety element of the elevator, since all elevators are equipped with the so-called “guides” to prevent the possible fall of the elevator cabin or counterweight. “catchers” - automatic braking system.

When operating in normal mode, the blocks are located on both sides of the guides, sliding freely along them while the cabin moves. However, it was precisely around these very “guides” that a dispute flared up between the Moscow FKR and Rostechnadzor. The fact is that during the mass replacement of the elevator according to the capital program of the Kyrgyz Republic, it is the steel guides (due to which the woman died) that cannot be replaced, but after cleaning and alignment they are left to serve... for another 25 years! When officials from the Ministry of Construction (there are very few technicians there) found out about this “trick,” they made an official request to Rostechnadzor: “...is it possible to continue to use the existing guides?”

In November 2020, a “cautious” response was received from the deputy head of Rosstandart, Alexey KULESHOV: “... replacing an elevator that has served its intended service life with the replacement or preservation of old guides does not contradict the requirements of the technical regulations. The installation of a new elevator in the building without replacing the guides complies with international practice and European legal standards.”

Dzhandzhiev might not have known or forgotten the fatal incident in “Scarlet Sails”, because he is not a Muscovite. And here, I think, the inspectors will point to an illiterate adjuster.

Elevators will continue to fall, since Roskomnadzor did not dare and was afraid to implement in full the Technical Regulations “Safety of Elevators” (TR CU 011/2011), which was adopted in order to ensure for many years the highest level of safety of vertical transport in the territory of the Customs Union . And this TR meant the complete restoration of the elevator fleet. The same meaning was laid down in regional overhaul programs. It was planned to replace each elevator unit that had served its intended period of 25 years with a more modern, reliable and “advanced” analogue.

If there are no accidents, but simply, during the next technical inspection, it is determined that the guides are out of order and their urgent replacement is needed, then all residents of the building will have to pay for new elevator repairs again, but now without government support.

In Art. 36 of the Housing Code clearly defines what MOP is in an apartment building. These are basements, roofs, the area around the building, staircases, communications. The same list also includes elevator equipment, the maintenance of which is a mandatory procedure.

The management company (hereinafter referred to as the Management Company) is obliged to carry out maintenance and inspection according to the schedule. Employees of the organization must respond to calls from people who find themselves in a locked cabin and start a lift that has stopped as a result of a breakdown. Repair of elevator equipment is also the responsibility of the management company. It should involve only accredited organizations that are obliged to carry out diagnostics and eliminate breakdowns of intra-house transport.

Replacing an elevator in an apartment building

Based on the results of the inspection of the mechanism, a decision can be made to restore individual elements. If this is considered irrational, the lift is dismantled and a new one is installed. The procedure is quite lengthy. It includes the following steps:

  1. Preparation and examination of the project.
  2. Construction works.
  3. Dismantling the old and installing a new elevator.
  4. Actions on electrification, automation.
  5. Commissioning works.
  6. Commissioning of the elevator.

Instead of replacement, it is possible to upgrade the equipment.

Who is responsible

An employee of the management organization is required to undergo special training and certification, know the Rules, and operating instructions. In each company, the person responsible for elevator facilities is appointed by order. Most often, all issues related to ensuring the safety of the lift are regulated by the chief power engineer of the management company.

Who should pay for the elevator replacement?

— Residents need to request information on replacing the elevator from the management company. The management company is obliged to provide any information you are interested in. As of today, there is no information or any trade secrets that is closed to residents and there should not be. People paid money for services and have the right to demand that these services be provided to them with high quality and in full. It is necessary to find out whether there is a passport for the elevator, whether state acceptance of the elevator was carried out after installation, whether the operation of the elevator was checked. The elevator must comply with all parameters established for elevator equipment. If this is the case, then there is no point in holding on to the old elevator.

The Moscow housing renovation program was approved on August 1, 2020. It provides for the resettlement of over 350 thousand apartments. Currently, 5,171 houses are included in the program. The housing renovation program provides for the construction of at least 30 million square meters at the expense of the city. m of housing.

Is a major overhaul included?

In addition to replacing new equipment as part of a regional program, other options for financing activities are possible. Only in this case, replacement of the elevator is possible at the expense of contributions for major repairs. Moreover, the monthly amounts contributed by those who live on the lower floors of the apartment building are also taken into account.

This type of work is aimed at maintaining a stationary lifting machine in working condition. If the elevator inspection report lists breakdowns and indicates incorrect operation of components, it is possible to replace individual elements of the mechanism. Current restoration measures imply the prompt restoration of transport if it suddenly breaks down.

A work schedule for replacing elevators under the capital repair program in 2020 has appeared on the Our City portal. On the website you can find out the timing of replacing lifts in each house, the name of the organization that will perform the work, as well as the number of the contract that the Moscow Capital Repair Fund concluded with the contractor.

Currently, the portal has published data on the replacement of 1,637 elevators ; a total of 1,820 elevators will be updated this year. The information on the site will be updated.

To find out about replacing elevators in a particular building, portal users need to enter the address and house number in the search bar. A map will appear on the screen with a pointer to this building, and to the right of it will be the “Apartment buildings” button. By clicking on this link, the user should select the “Regional Capital Improvement Program” tab, after which he will see information about replacing elevators.

Thus, on the “Our City” portal, Muscovites will be able to track the progress of work in their home, as well as send messages if violations are detected during their implementation. Responses to requests will be received no later than eight working days (starting from the working day following the day the message is published on the website).

Since 2020, Moscow has switched to the planned replacement of elevators in the year of expiration of their service life, without extending their service life. In the buildings, the major repairs of which are provided by the regional operator, there are virtually no elevators older than 25 years left.

As part of the overhaul program, specialists dismantle old equipment and install new lifts . Cabins, elevator doors on all floors of the building, equipment control stations, counterweights, winches, and speed limiters are subject to replacement. The new elevators operate smoothly while ensuring high precision car stopping.

Starting this year, the requirements for the repair of elevator equipment have been supplemented. According to the new rules, the walls in the cabins will be protected with a special wear-resistant coating of metallic color. The panels, with which you can select the desired floor, are made of stainless steel. The buttons will be illuminated when pressed, and the numbers on them will be duplicated in Braille for the blind and visually impaired.

Enlarged electronic displays and speakers are installed in the cabins for communication with emergency services. Display boards will be located on the ground floors of apartment buildings. With their help, it will be possible to determine on which floors the elevators are located. LED lighting in the cabins will be brighter.

All doors will be equipped with a photo curtain, which, thanks to sensitive sensors, will not allow them to close if there is a person in the opening.

Elevators will begin to be replaced in the capital's buildings in June . If there are several lifts at the entrance, they will be replaced one by one so that residents do not experience inconvenience. Before the start of work, an information stand will be installed at the entrance of the house with the phone numbers of a representative of the contractor, a technical supervision engineer of the fund, the fund's dispatch service and the city commission for monitoring the implementation of the regional capital repair program in Moscow. These numbers can be used to obtain all information about repairs.

The regional program for capital repairs in apartment buildings has been implemented in Moscow since July 2020. Today it includes more than 27.5 thousand houses . In total, up to 15 types of work are carried out - from repairing basic engineering systems and house elements to replacing garbage chutes.

Citizens whose apartments are located on the 1st and 2nd floors pay monthly fees for the maintenance of the lift, although the majority consider this to be unfair. However, taking into account the provisions of the Housing Code, persons living on the lower floors are the same shared owners of common property as the owners of other real estate. Therefore, the fee for an elevator in an apartment building also applies to them.

It is theoretically possible to exempt this category of the population from paying monthly amounts for the maintenance of the lifting mechanism: the decision must be made by a majority vote at a general meeting of apartment building residents. However, in practice this is unlikely - it is unlikely that citizens will want to exempt their neighbors from participating in the costs of maintaining common property.

Forced replacement

Restoration work or dismantling and installation of a new elevator is possible without taking into account the deadlines stated in the regional program. If money for major repairs is accumulated in a special account, in order to make a replacement, it is necessary to organize a meeting and put the issue to a vote. The decision will be positive if approved by a majority of votes. The application and the minutes of the meeting attached to it should be sent to the local housing and communal services department. If there is not enough money in the account, again at a meeting of owners it is decided how the difference will be repaid. You can increase your monthly payment or take out a loan.

Government support will speed up the replacement of elevators

On June 15, a meeting was held at the Russian Ministry of Construction on the development of tools for state support for the replacement of elevators during regional programs for the overhaul of multi-apartment residential buildings.

As Vladimir Yakushev, Minister of Construction and Housing and Communal Services of the Russian Federation, said on June 11, mention of state support for the replacement of elevators was included in the national economic recovery plan, and therefore the Russian Government instructed the Ministry of Construction to create practical assistance mechanisms by June 19. Their principles were discussed on June 15.

The head of the commission on elevator issues of the Public Council under the Ministry of Construction, a member of the presidium of the Public Council, Sergei Chernyshov, recalled that elevators in the housing stock of the Russian Federation that have served their designated service life must be replaced before February 15, 2025.

This large-scale task stems from the content of the Technical Regulations of the Customs Union “Safety of Elevators” (TR CU 011/2011).

An analysis carried out by the Russian Ministry of Construction showed that a significant part of the regions will not be able to cope with it in a timely manner without government support. Owners' funds received in capital repair funds (CRF) often turn out to be insufficient for this; the situation with replacing elevators in buildings where funds for major repairs are accumulated in special accounts is especially difficult.

Having come to such conclusions, the Russian Ministry of Construction turned to the Government, which responded and instructed the ministry to promptly present its vision of state support measures for updating the elevator fleet.

According to Sergei Chernyshov, initially the professional elevator community was inclined to the idea of ​​state subsidizing the replacement of each elevator, but the Government indicated another vector of state support - subsidizing the interest rate on loans attracted to replace elevators.

Within its framework, two directions are distinguished: 1) development of the actual mechanisms for subsidizing the interest rate; 2) studying the possibility of leasing elevators in residential apartment buildings.

According to experts, it is advisable to subsidize the interest rate in two cases: 1) when the contractor attracts a loan and provides an installment plan for the FKR - then the contractor or the bank that provided the loan can be compensated for the interest in the amount of the refinancing rate (5.5%); 2) in case of factoring, when the state budget compensates interest at the refinancing rate of the factoring company that purchased the debt of the reoperator to the contractor.

As for lending to capital repair funds and special accounts from the banking sector, it is unlikely that government support will come here in the near future. Although the Ministry of Construction is methodically developing this area of ​​activity, professionals saw in it a large amount of risks for banks and other unregulated aspects.

From the point of view of experts, for a number of reasons, leasing is unacceptable in the housing stock. For example, a leasing company does not have the right, when concluding an agreement with a regional capital repair fund, to transfer elevators into its ownership, because in accordance with the Housing Code of the Russian Federation, the elevator belongs to the common property of the apartment building.

In the housing and communal services sector, the leasing model is also unviable because there is no secondary market for elevators, and an elevator as a collateral cannot be taken from an apartment building without acute social consequences.

Thus, the projects for the accelerated replacement of elevators worked out by the industry, which should receive state assistance through the upcoming Government resolution, remain a sure way to fulfill the important requirement of the technical regulations by 2025.

If, together with the Ministry of Construction, elevator operators manage to promptly prepare a draft resolution, new opportunities will open up for the industry to increase the sales market for their products, employ the work of thousands of teams of specialized elevator organizations, and ensure the safety and comfort of living of citizens in apartment buildings.
