Federal Law No. 76-FZ of May 27, 1998 “On the status of military personnel” assumes that every contract serviceman has the right to housing. At the same time, the state guarantees assistance in purchasing or providing housing to military personnel who serve under a contract.
Since 2014, the Russian Government has improved the subsidy system for the military. If previously families of military personnel stood in line for housing from the Ministry of Defense fund, then in 2014 the funds necessary for the purchase or construction of residential premises began to be issued. As well as funds for improving existing living conditions.
A subsidy for military personnel is provided if the citizen began service under a contract before January 1, 1998.
The exception is cadets of military educational professional organizations and universities.

Legal regulation
Current legislation examines the issue of subsidizing housing conditions for military personnel from different angles. The main legislative documents on this issue are:
- Housing Code of the Russian Federation - it talks about the right of Russian citizens to housing and the rules for recognizing them as in need of improved living conditions.
- Federal Law No. 76-FZ “On the status of military personnel” dated May 27, 1998 - declares the right of military personnel to receive housing.
- Decree of the Government of the Russian Federation No. 512 of June 29, 2011 - provides a list of documents and a sample application for recognizing a military personnel as needing housing.
- Decree of the Government of the Russian Federation dated October 23, 2013 No. 942 - determines the rules for paying for housing that exceeds the established standards for area.

Subsidy calculation formula
Government Decree No. 76 clearly sets out the formula for calculating the amount of subsidies that the family of a serviceman under a contract can receive.
So, for the size of the final monetary amount, the decisive roles are played by:
- the standard cost of one square meter of residential premises in the Russian Federation, determined by the Ministry of Construction and Housing and Communal Services of the Russian Federation (St);
- standard of total housing area (Np);
- correction factor for military service life (K).
Subsidy amount formula: P=Np*St*K,
where P is the final amount of the subsidy.
At the same time, for each period of service under the contract, a correction factor is provided, which is taken into account when allocating funds to the serviceman and his family.
Correction factor
The amount for housing for military personnel can be increased due to an adjustment factor. The principle of its determination by the state is simple - the longer the service life, the greater the coefficient .
Clause 7 of the Rules for calculating subsidies for the acquisition or construction of residential premises (living premises) provided to military personnel - citizens of the Russian Federation and other persons in accordance with the Federal Law “On the Status of Military Personnel”:
The correction factor is set as follows:
- from 10 years to 16 years of military service – 1.85;
- from 16 years to 20 years of military service – 2.25;
- from 20 years to 21 years of military service – 2,375.
- Starting at the age of 21, the adjustment factor (2.45) increases by 0.075 for each year of military service over 21 years - up to 2.75 inclusive.
Those military personnel who have worked longer under a contract can count on a higher coefficient. And, therefore, for a large amount of subsidy.

Living space standard
The principle of allocated square meters is simple: the larger the family, the larger the standard.
The standard for providing living space for military personnel is 18 square meters of total living space per person.
Calculation example:
If a military man or a member of his family already owns housing, then the size of the standard is reduced by the area of the existing housing.
For example, a military spouse owns ¼ of the parent’s apartment, which is 10 square meters. The contract soldier's family consists of 3 people.
In this case, the standard will be: 18+18+(18-10)=44 square meters.
It is noteworthy that if a family rents housing under a social tenancy agreement, then the size of the standard can be reduced by the area of the occupied residential premises, unless in relation to it the tenants undertake in writing an obligation to terminate the social tenancy agreement, vacate it and transfer it to the body that provided it.
Therefore, when submitting documents for recognition as needy, a family can express in writing its desire to refuse a rented apartment or house after receiving financial assistance. That is, in fact, to indicate that if you have your own apartment or house, there is no need for rented housing, as well as for financial support in the form of benefits for paying for such housing.
Also, the standard for allocated housing may be reduced by the total area of residential premises by which, due to the actions and civil transactions committed by the military personnel and (or) members of his family, the size of the occupied (available) housing was reduced or in respect of which alienation was made. This is permissible for 5 years from the date of commission of the mentioned actions or civil transactions.
Additional square meters
According to the established rules, the total area of living space for which financial assistance is allocated from the state can be increased from 15 to 25 square meters.
The following citizens are entitled to an increase in area:
- commanders of military units;
- marshals;
- colonels/captains of the 1st rank;
- generals/admirals;
- teachers of military universities.
Increasing the area is at the discretion of the authorized bodies.
However, the minimum additional square footage is set at 15 square meters. The decision of the authorized bodies is usually influenced by several factors. For example, the presence of minor children a citizen has, their number, gender, the number of all family members as a whole, the existing housing situation.
If a family consists of two military men, then their standards and coefficients are not summed up. The right to receive payments from the state is assigned to the family, regardless of how many “contract workers” there are in it.
If the couple has not officially registered the marriage, then the right to financial assistance is exercised for each citizen separately.
In fact, an “unofficial” family can receive two payments.
Cost per square meter in the region
A military man and his family have the right to choose living quarters in any region of the country,
and not just at the place of last service.
Therefore, when determining the size of the subsidy, the cost of one square meter of space in the selected area is taken into account.
When calculating the average cost per square meter of housing, it is taken into account in which market it is purchased: primary or secondary. Since 2014, military personnel have had the opportunity to purchase housing in the secondary market.
For example, in Samara in 2020, the cost per square meter of housing on the primary market was set at 34,146 rubles.
Thus, a military man working under a contract for 12 years without a family can receive a subsidy for the purchase of an apartment in Samara in the amount of: 34146 * 33 * 1.85 = 2084613.3 rubles.
The average cost is not the actual or market value calculated by real estate agencies, but the one that is officially approved at the local level for the entire region and its individual parts.

L - the sum of the total area of residential premises owned by a military personnel, a citizen discharged from military service, and (or) members of their families by right of ownership and (or) occupied by them and or members of their families under a social tenancy agreement.

What can the cash payment be spent on?
Military families can spend the funds paid to them by the state in the following areas:
- buying a home in a “new building”;
- buying housing in the secondary market;
- home construction;
- mortgage loan fee;
- improving living conditions by increasing housing area.
Moreover, if the funds are used as a mortgage payment, it can be any payment : first, last, intermediate. Depending on the financial capabilities of the family.
In this case, the basis for receiving payment is a mortgage agreement with the bank, regardless of where exactly the housing was purchased - at the place of service or in any other region.
Construction of housing is permitted only on the condition that the family will no longer need to improve their living conditions after the construction of the property.
The procedure for recognizing those in need of housing
In this case, documents are submitted either to the place of service where the purchase of housing is planned, or to those territorial federal authorities that are located at the chosen place of purchase.
Recognition as needing housing is carried out in accordance with the Housing Code of the Russian Federation.
Who is recognized as needy
According to Article 51 of the Housing Code, the following categories of citizens receive the status of those in need of housing:
- those who live in premises that do not meet established requirements;
- those who live in premises without concluding a social tenancy agreement or in office living spaces of a smaller area than required by housing rules;
- those who live in premises under a social tenancy agreement or in office housing where one or more families live, if the family includes a patient suffering from a severe form of a chronic disease, in which living together with him in the same apartment is impossible.

Required documents
To obtain the status of someone in need of housing, you must submit the following documents:
- application of the established form;
- a copy of the passport of a citizen of the Russian Federation;
- copies of passports of all family members;
- copies of birth certificates of children under 14 years of age;
- a copy of the marriage or divorce certificate, if the marriage was concluded/divorced;
- copies of all documents that confirm the right to receive a subsidy for the purchase of residential premises (for example, an extract from Rosreestr about the absence of real estate in the property);
- documents confirming the family’s need for improved housing conditions;
- documents confirming benefits.
Additional documents may be required depending on the specific situation.
The application processing period is 30 working days.
The result is either recognition of the military man and his family as needing housing, or refusal to assign such status.
Algorithm of actions
Payment of EDV for the purchase of an apartment involves the following algorithm of actions:
- placing a serviceman and his family member in line under the regional program;
- opening a bank account to receive EDV;
- registration and submission of an application to the authorized institution of the Ministry of Defense of the Russian Federation for the provision of EDV;
- checking with the Rosreestr authorities information about the absence of housing in the property of the applicant for EDV;
- making a decision on payment.

Queuing is carried out at the executive authority of the constituent entity of the Russian Federation at the place of military service. A decision on an application for registration must be made within 30 days.
After the serviceman’s family is registered, he is placed on the waiting list of those in need. Upon reaching the required queue, the documents are submitted to the Housing Department of the Ministry of Defense of the Russian Federation - an application and a bank account agreement are submitted.
An exhaustive list of documents for obtaining EDV by military personnel is approved by Order of the Minister of Defense No. 510. The application must be signed by all adult members of the serviceman’s family.
Procedure for obtaining subsidies
After a family or single serviceman has received the status of those in need of housing, it is necessary to send an application to the Ministry of Defense of the Russian Federation (housing department) to receive a subsidy for the purchase or construction of living quarters, or for improving existing living conditions.
In order for the funds to be paid by the state, it is required to open a personal bank account to which the monetary assistance will be transferred.
In addition, it is necessary to conclude an agreement for the purchase of residential premises or its construction, and attach a copy of the agreement to the application.
The contract must include a clause on repayment of the entire cost of the apartment or house or part of this cost from the funds of the military certificate. Otherwise, the agreement may not be taken into account as a basis for receiving subsidies from the state.
According to established standards, the total period for transferring funds is 30 calendar days.
That is, during this time, the serviceman must receive a certificate for the purchase, construction or improvement of housing conditions in a bank account.
Features of purchasing an apartment or house using a certificate
Unlike family capital, a military certificate is issued only to the military person who receives it.
In this case, registration of ownership of a house or apartment remains at the discretion of the recipient of the certificate: personal or shared.
The law establishes that if there are minor children, their interests must be taken into account. That is, the parent who receives the certificate registers shared ownership for himself and his children without fail.
Citizens who were dismissed from contract service, but had more than 10 years of service and did not receive housing, do not lose their right to receive financial assistance.
Citizens who, for other reasons, are considered a priority for receiving benefits and subsidies (for example, large families), like military personnel, also have a priority right to receive assistance from the state. Including to receive financial payments for the purchase of an apartment or house.
