Government regulations and bills

The need to collect money for major repairs from residents is spelled out in Art.
169 Housing Code of the Russian Federation. The specifics of benefits are noted in Federal Law No. 271, issues of providing preferences to people with disabilities are regulated by Federal Law No. 181. In 2020, another law No. 399 was signed, according to which full or partial benefits for homeowners remain at the discretion of regional authorities. The obligation to carry out capital works and involve contractors is noted in Government Resolution No. 615.

Payment for Overhaul After 80 Years Law 2020

Pensioners are provided with benefits depending on age. For people over 70 years of age, this means receiving a 50% discount when paying contributions for major repairs, and pensioners over 80 years of age are exempt from paying completely. The advantage of this method is that the owners have the right to choose the types, timing and characteristics of repair work themselves. In addition, due to increased contributions, it is possible to carry out other types of modernization of the common property of the apartment building.

Who is exempt from paying contributions?

The circumstances of the exemption of citizens from collecting money for major repairs are noted in paragraph 2 of Art. 169 of the Housing Code of the Russian Federation. The following have the right to 100% payment withdrawal:

  • people renting residential premises under a social tenancy agreement;
  • tenants of apartments from a private person - fees are paid by the owner of the real estate;
  • residents of a building subject to demolition due to emergency conditions;
  • citizens living in an apartment building, the land under which is seized for the needs of the state or municipality.

Important! Low-income families who have benefits for paying utility bills in accordance with Art. 154 residential complexes are exempt from the fee.

Categories of beneficiaries

The Government of the Russian Federation has established a list of persons who have benefits accrued for the payment of all major repairs. These include several categories.

Veterans

Participants in battles during the Great Patriotic War, partisans (including persons who were under 18 years of age at that time), employees of the Ministry of State Security and the Ministry of Internal Affairs in the occupied territories, officers and privates who served during the Second World War, have a 100% exemption from fees.
International warriors, if they have awards confirming their involvement in the victory over Germany, or who contributed to the defeat of Japan, also do not pay money for major repairs.

Military personnel on the territory of the USSR, participants in the wars in Afghanistan and Syria, depending on age, are entitled to preferences in the amount of 50 and 100% of the amount of repair work.

Disabled people

Providing regional subsidies for planned major repairs is possible for disabled people of groups 1-2. They are entitled to a 50% discount upon presentation of their ID. Families raising children with disabilities have a similar discount amount.

Pensioners

Subsidies are administered by the constituent entities of the Russian Federation. Depending on the region, your local department may reduce the contribution rate for people just retiring. In most cases, a retiree must reach age 70 to receive 50% of the benefit. Citizens who are over 80 years old receive 100% reimbursement of payments.

Other

Preferences are also given to the following persons:

  • labor veterans;
  • heroes of the USSR and those who received disabilities during the war;
  • participants in the liquidation of the consequences of the Chernobyl accident, nuclear tests in Semipalatinsk;
  • people who survived the siege of Leningrad;
  • children who were in concentration camps at the time of World War II;

  • large families.

Who is eligible for benefits?

Preferences established at the federal level are provided to the following categories of senior citizens:

  • disabled people of groups 1 and 2, people with disabled children;
  • veterans of labor, WWII, military operations;
  • victims of the Chernobyl accident and their family members.

Persons of retirement age are exempt from paying part of the contributions if they are over 70 years old, and entirely when they turn 80. However, older citizens must meet a number of conditions. In Moscow, non-working apartment owners receive benefits.

The size of the preference ranges from 30 to 100%.

Pensioners over 70 years old

Residents of some regions are provided with such a benefit automatically if executive authorities have information about their right to it. More often, for registration you need to write an application and submit documents to the social security authorities.

Refund of fees for major repairs to pensioners upon reaching 70 years of age is 50%.

Conditions for calculating benefits:

  • an elderly person lives alone;
  • has the right of ownership of the apartment;
  • non-working pensioners, disabled people of groups 1 and 2 live with him;
  • pension is the only source of income.

Elderly citizens over 80 years of age

This category of owners is provided with full reimbursement of contributions if they live alone or with non-working pensioners, disabled people of groups 1 and 2. When able-bodied citizens who have not reached retirement age are registered in the living space, the benefit does not apply.

Payment for major repairs after 80 years of age will be refunded if pensioners pay utilities on time.

Veterans

The subsidy amount for this category of citizens is 50%. Benefits are valid on the basis of Federal laws.

Those affected by the consequences of the disaster at the Chernobyl nuclear power plant include:

  • accident liquidators;
  • persons who have lost their health due to radiation;
  • members of their families.

For disabled people

The amount of compensation for this category of elderly people is 50%. To obtain it, you must provide a certificate confirming the assignment of a disability group.

If there is a child with disabilities in the family, a discount is provided, regardless of the number of people living in the apartment.

The relief is granted to the following categories of disabled citizens:

  • disabled people of groups 1 and 2;
  • disabled children;
  • families with a disabled child.

Procedure for applying for benefits

To apply for subsidies for major repairs, residents of apartment buildings need:

  1. Find out whether the building is included in the regional program by contacting the construction department or housing office;
  2. Pay off utility debts in full;
  3. Receive a payment slip indicating the amount of the contribution - it is the basis for subsidizing;
  4. With this “stub” and a document confirming your right to benefits, as well as a receipt, contact the territorial MFC.

Subsidies are of a declarative nature, their amount is calculated according to regional standards for apartment area.

Important! If a citizen does not pay utility bills for 2 months, subsidies are stopped until debts are paid off.

List of documents

For owners of residential premises applying for discounts and compensation, the following documents are established:

  • copies and originals of passports of the owner of real estate and his family members;
  • a certificate confirming membership in a preferential category;
  • receipts indicating the cost of payments for major repairs up to the time of application;
  • income certificates for all family members;

  • certificates confirming the absence of debts for utility bills;
  • application for a subsidy;
  • personal account where the refund will be made.

Result of the request: what do we get?

The size of the subsidy, which provides a discount for major repairs in a residential building, is determined by the number of family members or the apartment area standards.

It is calculated in the following order:

  • a person living alone receives a discount on only 33 square meters. For two citizens, subsidies are calculated for 42 square meters, for three – 18 square meters per person;
  • when paying for real estate in shared ownership, preferences are granted only to the beneficiary;
  • the state compensates only for payments obligatory for homeowners; residents pay additional funds on their own;
  • for profitable households, major repairs can be paid for from their source of income.

Important! The stated provisions are general. The specific type of benefit depends on the subject of the Russian Federation.

Calculation example

Let's consider how a subsidy will be calculated for large families for major repairs, based on a housing area of ​​60 square meters, parents and three minors:

  1. The social norm indicator is 18 square meters. m., which for 5 will be 90 sq. m.;
  2. The discount for this category is 30%;
  3. The ruble equivalent of the preference is 60 sq. m.*price per meter*30%;
  4. For 2020, you were supposed to pay 7 rubles per square meter for major repairs. 50 kopecks;
  5. Benefit calculation – 60 sq. m.*7.5*30% = 135 rub.;
  6. Monthly payment 60 sq. m * 7.5 – 135 = 315 rub.

Calculation example for apartments with shared ownership

Let us clarify how the payment preference will be calculated for two owners. The owners of the real estate are an 80-year-old grandmother and an adult grandson with a Group 2 disability. Each of them has a discount. The area of ​​real estate in a multi-storey building is 54 square meters.

  1. The share ratio of owners is 54 sq. m.: 2 = 27 sq. m.;
  2. The grandmother is exempt from collecting the contribution, the grandson pays only 50%;
  3. Using the city of Moscow as an example, its part will be 27 square meters. m.*7.5*50%=101.35;
  4. The total amount for a family is 101 rubles. 22 kopecks

In 2020, the subsidy assigned to pay for the planned capital repairs provides for citizens to contact the local social protection center.

Algorithm of actions

Reduced payment for capital work for persons living in an apartment building is not a standard preference. To obtain it, the applicant will need:

  2. See if utilities have been paid. If there is a debt on these receipts, pay it off;
  3. Pay the first payment in full for major repairs;
  4. Collect the necessary documents - copies and originals, social rent agreements or rental agreements from a private person;
  5. Submit a package of papers to the required department;
  6. To write an application;
  7. If the decision is positive, the subsidies will be valid from the 1st day of the month after which the application is submitted.

Important! Government agencies consider the application for 10 days, and then notify the applicant.

Benefit for major repairs for pensioners after 80 years of age

The social protection service is responsible for paying compensation from the budget to various categories of citizens. You need to contact the territorial office at your place of residence. You can submit an application and documents to any MFC; in a number of constituent entities of the Russian Federation it is possible to apply for compensation on the State Services website. Residents of Moscow can contact “My Documents” or the regional departments of the city center for housing subsidies.

Conditions for payment of compensation

The legislation stipulates that everyone must pay depending on the area of ​​occupied housing, and compensation to beneficiaries is sent from the appropriate budget, which includes funds to support socially vulnerable groups of the population. This principle is applied when calculating benefits for capital repairs to disabled people , labor veterans or the poor.

  1. Heroes of the USSR, Russian Federation and full holders of the Order of Glory, spouses and parents of deceased heroes and holders, if they do not receive a monthly cash payment - EDV.

You also don’t have to pay contributions for major repairs if money for major repairs is saved up in a special bank account and a certain amount has accumulated—the minimum size of the capital repair fund. In this case, the owners can suspend the payment of contributions. To do this, they must hold a meeting and decide not to pay.

How to return funds already paid

The overhaul program includes a house that has been put into operation. But it happens that the program is approved earlier and the house is included in it in advance, before commissioning. Then the obligation to pay contributions will appear later. But no later than 5 years from the date of inclusion of the house in the regional overhaul program.

Art. 169 of the Housing Code, part B 2, paragraph 1, assigns to local authorities the right to regulate the issue of providing benefits in their region. The law provides for the provision of benefits for the payment of capital repairs to pensioners only for a certain part of the housing.

Is a single pensioner required to pay major repairs in 2020 after turning 80?

The law established that in cases where a pensioner over 80 years of age lives in an apartment, payments are not collected. Please note: if a person who has not reached the specified age lives with a pensioner and this person is the owner of the premises, then the benefit will not be provided!

The amount of the contribution is determined based on the area of ​​the apartment. A special coefficient is applied to it, which is established by the authorities of the subject of the federation. In other words, the monthly contribution amount is equal to the area of ​​the apartment multiplied by the regional coefficient. Nuances of the program

The targeted program operates on the basis of an agreement between the association of citizens and the Moscow municipality:

Issue rules

Terms of provision for the city of Moscow:

  • the operational period of structures and intra-house communications has expired;
  • At a meeting of premises owners, a decision was made to carry out major repairs in accordance with Art. 44, 45, 46 and 158 of the Housing Code;
  • apartment owners invest at least 5% of their money;
  • the volumes, order and types of work were approved at the general meeting;

  • evidence of the quality and sizing of the repaired objects is provided.

Important! Applications are accepted from January 15 to March 15 of the current year.

For citizens

Payment discounts can be received by persons who are employers, members of cooperatives, or owners. The preference has nuances:

  • the family should not have debts to pay utility bills;
  • money is transferred according to the details - bank account number or social card of a Moscow resident;
  • the size of the benefit is affected by total income, the number of family members and the cost of utilities;
  • Recipients of the medal “For the Defense of Moscow”, home front workers (from 07/22/41 to 01/25/42), honorary donors of the Russian Federation and the USSR, families with many children, heroic parents, disabled people, incl. families with disabled children.

Important! From July 1, 2020, in the city of Moscow, preferences are automatically included in payments for housing and communal services.

Saint Petersburg

In the Northern capital there are also citizens who have a discount on contributions paid for major repairs of a residential building - benefits are available:

  • pensioners aged 70-79 years (50%) and over 80 years old (100%);
  • citizens who participated in the defense of Leningrad during World War II;
  • honorary donors of the USSR and the Russian Federation.

Crimeans have received benefits since 2020. In addition to people who are entitled to discounts at the federal level, compensation is provided to:

Benefits for major repairs for pensioners after 70 and 80 years of age: what you can count on in 2020

The benefit can be received by citizens who, in accordance with the law, are entitled to it, that is, pensioners over seventy or eighty years of age, living alone or with non-working household members. At the same time, persons over seventy years of age are compensated or subsidized only half of the contribution, and citizens over eighty years of age will be reimbursed in full.
