  • property conditions: availability of equipped premises for games, sleep, and other needs;
  • safety measures for the child in accordance with his age: restriction of access to medicines, devices, and other dangerous things;
  • family income;
  • the presence of circumstances that pose a threat to the health and life of the child, his moral, spiritual and physical development.

Important! When drawing up the document, guardianship and trusteeship officials conduct a conversation with children and other family members to clarify relationships and eliminate the presence of psychological and physical violence against minors.

Briefly: the act is needed in order to clarify the conditions for keeping children, and when establishing guardianship or adoption, to identify the relationship in the family of the guardian or adoptive parent, their property status. When is an act required?

The act is required in almost all situations when it comes to the rights and interests of children:

  1. Deprivation of parental rights. The document is submitted to the court by the OiP after checking the parent who wants to be deprived of the rights to the child.
  2. Contact of teachers or employees of a medical institution to the Department of Educational Inspection in case of suspicion of failure of the mother or father to fulfill obligations to the child: failure to comply with hygiene rules, lack of care, ban on education, cruel treatment.
  3. A citizen's appeal to the OOiP to establish guardianship, trusteeship, patronage, patronage, adoption.

Who has the right to draw up an inspection report?

Water supply and sewerage

1. The cold water supply system of distribution lines is in unsatisfactory condition:

2. The sewer (cast iron) deck chair is in poor condition:

— the pipeline has chips and cracks on the sockets, in some places there are cement bandages along the deck,

Types of living conditions

At the end of the act, the OOiP employee, when considering an application for adoption or placing a child under guardianship, puts a short resolution on the conditions - satisfactory or not. Let's look at what is meant in both cases.

Satisfactory

Satisfactory conditions mean that the child lives in a comfortable environment, namely:

  • availability of housing of sufficient space, allocation of a separate room to the minor;
  • optimal level of family income;
  • good furniture and household appliances in sufficient quantity;
  • connection of utilities: water supply, sewerage, electricity, gas supply;
  • favorable family environment.

The signature “satisfactory” is most often placed on documents.

Unsatisfactory

If conditions are unsatisfactory, there is no chance to take the child into custody. If the act is drawn up in the process of depriving parental rights, it will contribute to this.

What is meant here:

  • a child living in housing that is in a dilapidated state;
  • fungus in the house, lack of minimal repairs;
  • unfavorable sanitary conditions in the living space;
  • low family income;
  • poor relationships between parents and children.

Legal advice: if you live in a dilapidated house, submit documents to Social Security to get on the waiting list to improve your living conditions. This is possible if the housing became this way not as a result of alcoholism or the antisocial lifestyle of the owners, but due to circumstances beyond their control. An alternative option is to recognize the apartment building as unsafe: in this case, the owners are subject to resettlement in more suitable housing.

Important! If you rent an apartment under a rental agreement and do not have your own property, this is not a basis for refusing to adopt you or appoint you as a guardian. All nuances are considered objectively; the presence or absence of housing on the right of ownership is not a decisive factor when making an OO&P decision.

The act is drawn up in two copies. One remains in the OOiP, the second is sent to the applicant. The document must be issued to applicants in all cases.

OOiP may refuse to issue an act if an incomplete list of documents is provided, the application is filled out incorrectly, or a citizen applies while under the influence of alcohol or drugs.

IPDN Act

PDN inspectors draw up a report when registering a child, and in other cases.

The document includes the following information:

Residential inspection report - registration rules and sample

How are living conditions checked?

OOiP employees notify about the inspection in advance when it comes to establishing guardianship or adoption.

  1. On the appointed day, the POiP worker comes to the place of residence of the guardian or adoptive parent and gets acquainted with the family members. The applicant is obliged to provide him with access to all rooms and tell him where the minor will live after determining guardianship.
  2. The employee assesses the conditions, records everything, and conducts a conversation with everyone living in the living space.
  3. At the time of verification, written consent to guardianship is issued from all family members over 18 years of age, but the opinion of children is also taken into account.

If necessary, the guardianship officer has the right to interview neighbors to obtain a brief description of the guardian or adoptive parent.

Finally, within three days, a report is drawn up and sent to the applicant.

Checking conditions after adoption or guardianship

Having entered into a guardianship agreement or adopted a child, you should not think that the PA will not check the living conditions - this is not the case.

During guardianship, government agency employees visit guardians with the following frequency:

  • 1 time during the first month after the decision to appoint a citizen as a guardian is made;
  • Every 3 months for the first year thereafter;
  • Every six months for the second year.

The deadlines are regulated by Decree of the Government of the Russian Federation dated May 18, 2009 No. 423.

Adoptive parents are checked less frequently:

  • For the first time, the examination is carried out after 5 months from the date of entry into force of the decision on adoption;
